  • Live Plants: You understand and agree that you are purchasing live plants. We take great care to ensure our plants are healthy and accurately represented on our website. However, please be aware of the following:
    • Appearance: The images on our website are representative of the plant species and cultivar. The plant you receive may vary in size, shape, and color. We do not guarantee that every plant will look identical to the one pictured.
    • Pests and Imperfections: We inspect our plants for pests and diseases. However, we cannot guarantee that plants will be completely free of all pests or cosmetic imperfections. Minor leaf blemishes or signs of past pest activity that do not compromise the plant's health are not considered defects.
    • Plant Health: We guarantee our plants are healthy when they leave our nursery. We are not responsible for the health of the plant after it has been in your care, as we cannot control its environment (e.g., light, water, temperature, soil).
  • Product Descriptions: We strive to provide accurate information about our products, but we do not warrant that product descriptions or other content are completely accurate, reliable, or error-free.

4. Orders, Payments, and Shipping

  • Pricing: All prices are listed in U.S. Dollars (USD). Prices are subject to change without notice. The price charged for an order will be the price in effect at the time the order is placed.
  • Payment: We accept payment through the methods provided by Shopify Payments. By providing payment information, you represent and warrant that you are authorized to use the designated payment method.

    • Shipping is stressful for live plants. Some wilting, leaf drop, or yellowing upon arrival is normal. We package our plants with extreme care to minimize this stress.
    • We are not responsible for damage caused by extreme weather conditions during transit, carrier delays, or packages left unattended after delivery. Please track your package and bring it inside as soon as possible.

5. Returns, Refunds, and Guarantees

  • Live Plant Policy (Perishable Goods): Due to the perishable nature of live plants, we do not accept returns. All sales of live plants are final.
  • Damaged on Arrival: If your plant arrives severely damaged (e.g., broken stems, crushed, rotted), you must contact us within 48 hours of delivery.
    • To file a claim, please email us at [Your Customer Service Email] with your order number and clear photos of the damaged plant and the packaging.
    • We will assess the damage and, at our discretion, may offer a replacement or a store credit. We do not offer refunds for damage claims.
  • Non-Perishable Goods: For non-plant items (e.g., pots, tools), you may return unused items in their original packaging within 14 days for a refund, less the original shipping cost. Return shipping is the responsibility of the customer.

6. Intellectual Property All content included on this site, such as text, graphics, logos, images, and software, is the property of Eco Raíces or its content suppliers and is protected by United States and international copyright laws. The "Eco Raíces" name and logo are trademarks of Eco Raíces.

7. Limitation of Liability To the fullest extent permitted by law, Eco Raíces shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; or (c) unauthorized access, use, or alteration of your transmissions or content.

In no event shall the aggregate liability of Eco Raíces exceed the greater of one hundred U.S. dollars ($100) or the amount you paid us, if any, in the past six months for the services giving rise to the claim.

Indemnification You agree to indemnify and hold harmless Eco Raíces and its employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.
